Content on Hangset
Hangset is a tool that lets users upload their own photographs to plan gallery wall arrangements. Photographs uploaded by a user are private to that user and are not published or made publicly available by Hangset. When you upload content to Hangset, you represent and warrant that you own it or otherwise have all rights necessary to use it, as set out in our Terms of Service.
Reporting Alleged Copyright Infringement
If you are a copyright owner, or authorized to act on behalf of one, and you believe that content available through Hangset infringes your copyright, you may submit a written notice to our Designated Agent (the "DMCA Notice"). Your DMCA Notice must include all of the following:
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
- Identification of the copyrighted work claimed to have been infringed, or, if multiple works are covered by a single notice, a representative list of such works.
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity, and information reasonably sufficient to permit us to locate the material.
- Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and email address.
- A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that you are the copyright owner or are authorized to act on behalf of the copyright owner.
Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing may be liable for damages.
Designated Agent
Send your DMCA Notice to our Designated Agent:
Hangset LLC Attn: DMCA Designated Agent 2108 N St, Ste N, Sacramento, CA 95816, US Email: dmca@hangset.com
Our Response
Upon receiving a valid DMCA Notice, we will remove or disable access to the allegedly infringing material within a reasonable time and will make a good-faith effort to notify the user who uploaded it. We may also, at our discretion, take other action we deem appropriate, including in accordance with our repeat-infringer policy below.
Counter-Notification
If you are a user whose content has been removed or disabled and you believe the material was removed as a result of mistake or misidentification, you may submit a written counter-notification (the "Counter-Notice") to our Designated Agent. Your Counter-Notice must include all of the following:
- Your physical or electronic signature.
- Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access was disabled.
- A statement, under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if your address is outside the United States, for any judicial district in which Hangset may be found), and that you will accept service of process from the person who provided the original DMCA Notice or an agent of that person.
Upon receipt of a valid Counter-Notice, we will forward it to the person who submitted the original DMCA Notice. The removed material may be restored, or access to it re-enabled, in not less than 10 and not more than 14 business days following receipt of the Counter-Notice, unless our Designated Agent first receives notice that the original complainant has filed a court action seeking to restrain the allegedly infringing activity.
Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material was removed or disabled by mistake or misidentification may be liable for damages.
Repeat Infringers
In accordance with the DMCA and other applicable law, Hangset has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, the accounts of users who are determined to be repeat infringers. We may also, at our sole discretion, limit access to the service or terminate the accounts of any users who infringe the intellectual-property rights of others, whether or not there is any repeat infringement.
