Terms of Service

These Terms of Service govern your use of the website located at https://hangset.com and any related services provided by Hangset LLC ("Hangset," "we," "us," or "our").

By creating an account, accessing https://hangset.com, or using our services, you agree to abide by these Terms of Service and to comply with all applicable laws and regulations. If you do not agree with these Terms of Service, you are prohibited from using or accessing this website or using any other services provided by Hangset LLC.

We, Hangset LLC, reserve the right to review and amend any of these Terms of Service at our sole discretion. Upon doing so, we will update this page and, where the changes are significant, provide notice. Any changes to these Terms of Service take effect from the date of publication.

Eligibility

You must be at least 18 years old to create an account or use Hangset. By using our services, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms of Service.

Limitations of Use

By using this website, you warrant on behalf of yourself, your users, and other parties you represent that you will not:

  • modify, copy, prepare derivative works of, decompile, or reverse engineer any materials and software contained on this website;
  • remove any copyright or other proprietary notations from any materials and software on this website;
  • transfer the materials to another person or "mirror" the materials on any other server;
  • knowingly or negligently use this website or any of its associated services in a way that abuses or disrupts our networks or any other service Hangset LLC provides;
  • use this website or its associated services to transmit or publish any harassing, indecent, obscene, fraudulent, or unlawful material;
  • use this website or its associated services in violation of any applicable laws or regulations;
  • use this website in conjunction with sending unauthorized advertising or spam;
  • harvest, collect, or gather user data without the user's consent; or
  • use this website or its associated services in such a way that may infringe the privacy, intellectual property rights, or other rights of third parties.

Intellectual Property

The intellectual property in the materials contained in this website are owned by or licensed to Hangset LLC and are protected by applicable copyright and trademark law. We grant our users permission to download one copy of the materials for personal, non-commercial transitory use.

This constitutes the grant of a license, not a transfer of title. This license shall automatically terminate if you violate any of these restrictions or the Terms of Service, and may be terminated by Hangset LLC at any time.

Your Content and the Rights You Grant Us

You retain all ownership and all intellectual-property rights in the photographs and other content you upload to Hangset ("Your Content"). We claim no ownership of Your Content.

To operate the service for you, you grant Hangset LLC a limited, non-exclusive, worldwide, royalty-free license to host, store, reproduce, resize, create thumbnails of, transmit to our third-party AI provider, and display Your Content back to you, solely for the purpose of providing and improving the Hangset service to you. This license exists only so that we can deliver the features you are using — ranking, composition, and print specifications.

This license terminates when you delete Your Content or close your account, except that (a) we may retain copies in routine backups for a limited period before they are overwritten, as described in our Privacy Policy, and (b) we cannot recall content already transmitted to our AI provider for processing, which is handled under that provider's terms as described in our Privacy Policy.

We will not use Your Content to train AI models, for advertising, or for any promotional purpose without your separate, explicit consent.

You represent and warrant that you own Your Content or otherwise have all rights necessary to upload it and to grant the license above, and that Your Content does not infringe the intellectual property or other rights of any third party.

Credits, Payments, and Refunds

Hangset is offered on a credit basis. One credit corresponds to one gallery wall project.

Free tier. New accounts include 2 gallery wall projects at no charge, with access to all features.

Gallery Pack. You may purchase additional capacity through the Gallery Pack: a one-time payment of $9 USD that grants 5 additional gallery wall projects. The Gallery Pack is a one-time purchase. It is not a subscription, and it does not automatically renew or recur.

Payment processing. Payments are processed by Stripe. We do not receive or store your full payment card details; we retain only a payment reference.

Pricing changes. We may change our pricing at any time. Any change applies only to purchases made after the change takes effect and does not affect credits you have already purchased.

Refunds. Unused Gallery Pack credits are refundable within 14 days of purchase upon request. Gallery wall projects that have already been generated are not refundable, as the service for those projects has been delivered. To request a refund, contact us at support@hangset.com.

AI Recommendations and Print Specifications

Hangset uses artificial intelligence to score your photographs and to generate gallery wall arrangements, including written rationales and print specifications such as photo sizes, mat widths, frame dimensions, and gap measurements.

These outputs are recommendations only. They are generated by automated systems and may contain errors. You are responsible for reviewing and independently verifying all measurements and specifications before printing, ordering, framing, or making any purchase based on them. Hangset does not sell, produce, or ship prints or frames; print fulfilment is handled by your chosen framer or print lab. We are not responsible for results produced by any framer or print lab, or for any costs arising from specifications you did not verify.

Liability

Our website and the materials on our website are provided on an 'as is' basis. To the extent permitted by law, Hangset LLC makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property, or other violation of rights.

In no event shall Hangset LLC or its suppliers be liable for any consequential loss suffered or incurred by you or any third party arising from the use or inability to use this website or the materials on this website, even if Hangset LLC or an authorized representative has been notified, orally or in writing, of the possibility of such damage.

In the context of this agreement, "consequential loss" includes any consequential loss, indirect loss, real or anticipated loss of profit, loss of benefit, loss of revenue, loss of business, loss of goodwill, loss of opportunity, loss of savings, loss of reputation, loss of use and/or loss or corruption of data, whether under statute, contract, equity, tort (including negligence), indemnity or otherwise.

Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

Accuracy of Materials

The materials appearing on our website are not comprehensive and are for general information purposes only. Hangset LLC does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on this website, or otherwise relating to such materials or on any resources linked to this website.

Hangset LLC has not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement, approval or control by Hangset LLC of the site. Use of any such linked site is at your own risk and we strongly advise you make your own investigations with respect to the suitability of those sites.

Right to Terminate

We may suspend or terminate your right to use our website and terminate these Terms of Service immediately upon written notice to you for any breach of these Terms of Service.

Severance

Any term of these Terms of Service which is wholly or partially void or unenforceable is severed to the extent that it is void or unenforceable. The validity of the remainder of these Terms of Service is not affected.

Dispute Resolution; Arbitration and Class-Action Waiver

Please read this section carefully. It affects how disputes between you and Hangset LLC are resolved.

Most concerns can be resolved informally by contacting us at support@hangset.com, and we encourage you to do so first. If we cannot resolve a dispute informally, you and Hangset LLC agree that any dispute arising out of or relating to these Terms of Service or the service will be resolved by binding individual arbitration, rather than in court, except that either party may bring qualifying claims in small-claims court.

Class-action waiver. You and Hangset LLC agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding.

Opt-out. You may opt out of this arbitration agreement within 30 days of first accepting these Terms of Service by sending written notice to legal@hangset.com. If you opt out, the Governing Law section below governs disputes between us.

Nothing in this section limits either party's right to seek injunctive or equitable relief for intellectual-property infringement or misuse.

Governing Law

These Terms of Service are governed by and construed in accordance with the laws of California. Subject to the Dispute Resolution section above, you irrevocably submit to the exclusive jurisdiction of the courts located in California.
